Temporary Disability and Risk during Pregnancy

Temporary disability (IT) and risk during pregnancy and natural breastfeeding (REL)

WARNINGS:

  • A new rule on temporary incapacity affecting workers in the General Social Security System has been published, according to which the copy of the leave for the company is removed. This rule, and its development order, do not apply to MUFACE officials, even if they receive health care through public health services. Therefore, the doctors will continue to issue the two copies of the model of part of MUFACE, and the mutualists will present in their personnel unit the one destined for the Administration.

Requirements to be in IT

  • Suffer a pathological process due to illness or accident, common or professional, that temporarily prevents the provision of services.
  • Receive health care to recover provided by MUFACE.
  • Obtain the sick leave granted by the staff body.

The parts of IT

  • They justify the absence from work due to an illness that temporarily prevents the provision of the service.
  • They show that health care is provided to recover from the disease.
  • They are issued in duplicate, one copy for the mutualist person and another for the Administration.
  • When the mutualistic person presents them in their personnel unit, they are applying for sick leave, a document with which the agency grants the IT.
  • The official model can get it at the bottom of this page. Models prior to 2019 and the old talonnaires of autocopiative parts are not valid.
  • There are two types: the IT part and the part for risk situations during pregnancy and natural breastfeeding.
  • There is no specific part of professional illness or accident in the act of service.
  • It is very important to complete your information because it is the advice that the staff body needs to grant the license and initiate the IT:
    • Clear and consecutive dates in the confirmation parts.
    • Specify whether the new process is relapsed from a previous one.
    • Complete data, of mutualist and optional person.
    • The ICD-10 diagnostic code.
    • Procedural ICD-10 is not allowed. In this case, the diagnostic ICD-10 must be indicated and the option indicated in the additional section of the part.
    • Estimated probable duration of the entire process (not of each party).
    • Limitations of functional capacity.
  • The confirmation part No. 1 is usually issued within 15 days of the initial, except for necessarily shorter processes or for which it is recommended, for better medical care, to extend the expedition between one part and the other up to a maximum of 30 days.
  • If the IT situation reaches the 10th or 16th month, medical personnel must fill in the section corresponding to the additional ratification report.

Risk situation during pregnancy or risk situation during natural breastfeeding

Risk situation during pregnancy or risk during natural breastfeeding

  • To be in one of these situations it is necessary to obtain from the staff body a specific license of risk during pregnancy or natural lactation, by virtue of the specific part for these situations that is issued by the medical staff that attends to the mutualist.
  • The staff member carries out the procedure for determining that the job poses a risk to the staff member, the foetus or the nursing baby, and it is not possible to change to another job.
  • It will differentiate between the situation of risk during pregnancy and the situation of IT related to pregnancy or pregnancy at risk.

The part for risk situations during pregnancy or natural breastfeeding

  • The part for risk situations, other than the part of IT, is coded by default as REL, that is, it does not carry diagnostic code CIE-10, since a risk situation is not a situation of sick leave or accident.
  • This special part constitutes a medical report for the staff body indicating the state of pregnancy of the mutualist and the probable date of delivery, or the state of natural lactation and the date of birth of the child. With this part, the personnel body initiates the procedure to determine whether there is a risk for the mutualist, the fetus or the nursing baby, and whether or not it is possible to change the position to the mutualist. If not, it will grant the license for risk during pregnancy or risk during natural lactation.
  • This part for REL situations is not the one that should be filled in if the situation is IT related to pregnancy or pregnancy at risk. In this case the part is the specific one for the IT situations.
  • The REL parts are initially issued for three months.
  • If the risk situation exceeds 90 days, the REL parts shall be issued for a maximum of 30 days.

From day 91 in the IT or REL situation, the right to receive the subsidy paid by MUFACE is generated:

Temporary disability allowance

Risk allowance during natural breastfeeding

Order PRE/1744/2010, of 30 Junewhich regulates the procedure for the recognition, control and monitoring of situations of temporary incapacity, risk during pregnancy and risk during natural breastfeeding in the Special Social Security Regime for Civil Servants of the State.
